Citing code violations, a lack of effort to clean up the property and a potential hazard to children, the Holbrook City Council voted unanimously Tuesday evening to revoke a conditional use permit issued to Maverick Recycling.
“I don’t think we should speculate, we need to look at what’s been presented,” Councilman Bobby Tyler said regarding the decision. “It’s been a year and a half and there’s been no good faith effort. It looks the same.”
Tyler pointed out that not only are the code violations a concern, but the danger to children posed by unsecured appliances and vehicles make action necessary.
Holbrook Planning and Zoning Commission Chairman Mike Sample explained to the council that the commission and city officials have been in contact with company owners for at least 18 months in an effort to reach a resolution. He noted that when the permit was issued, the recycling center was only authorized to take “light” recyclables such as aluminum cans and all work, as well as equipment and recyclables, was to be contained within the building.
“We gave them time to clean the property up twice,” he said, noting that the commission agreed in March to recommend that the council revoke the special use permit.
City Manager Ray Alley remarked, “They haven’t lived within any of the requirements of the special use permit.”
He told the council that he recognizes that it is not the only property within the city in violation of city code, but due to limited manpower, most code violations are found through complaints filed by citizens. According to Alley, action against Maverick Recycling began with a citizen complaint and over the last 18 months multiple attempts have been made to work with the owners to clean the property. He noted that he also recommended the permit be revoked due to a lack of compliance, and a lack of serious effort to clean and maintain the property.
Council members voted to revoke the permit and give the owners 30 days to clean the property. They also asked Alley to work with the city attorney to complete the revocation process.
