- DESCRIPTION OF PROPERTY
SEIZED
LOCATION OF SEIZURE
FACTUAL AND LEGAL BASIS FOR
SEIZURE
A description of the property seized is as follows: U.S. Currency $59,034.00. The property was impounded as evidence on or about July 07, 2025, on I-40 eastbound, milepost 302. A traffic stop was conducted on the vehicle for the radar detector blocking the view and for speeding (79 m.p.h. in a 75 mile per hour zone). An Arizona Department of Public Safety trooper made contact with an individual, identified by a Colorado drivers license as Joseph Richard Bookhamer (DECEASED). During the contact the trooper advised Mr. Bookhamer the reason for the stop and had Mr. Bookhamer back to his patrol vehicle. A driver’s license check was returned on Mr. Bookhamer that showed he had a U.S. Marshall warrant out of New Mexico for a probation violation for drug charges and was armed and dangerous. A warning was completed for the windshield attachment and a speed violation. The trooper asked for consent to search and Mr. Bookhamer said yeah, read the consent, and then refused consent. A Navajo County Sheriff’s deputy arrived with his K-9 to do an exterior sniff and the K-9 alerted. 113.6 pounds of methamphetamine, 1.6 pounds of fentanyl pills, and 1.56 ounces of crack cocaine, as well as the U.S. Currency $59,034.00 were found in the vehicle.
During an interview after his arrest, Mr. Bookhamer admitted that individuals had rented a car for him, provided him a cellular phone to use, and gave him $150,000 in cash to purchase drugs in Phoenix. Bookhamer admitted he was being paid $5,000 to deliver the drugs back to the state of Colorado. Bookhamer indicated that not all of the money was used to buy drugs as the individuals he acquired the drugs from in Phoenix had a hard time gathering all of the drugs he wanted to purchase. At the time of his arrest on July 7, Mr. Bookhamer also had a federal warrant for his arrest in a case related to drug trafficking.
The name of the law enforcement agency making the seizure was the Arizona Department of Public Safety.
In an odd turnoff events, Mr. Bookhamer passed away in the Navajo County jail, apparently from natural causes, a few days after his arrest.
The specific statutory grounds for the seizure are set forth above in Section I of this Notice of Seizure and Notice of Pending Forfeiture. The specific factual grounds for the seizure are set forth in DPS Incident Report #I25040666, which is attached hereto and incorporated herein by reference.
- YOUR OBLIGATIONS TO FILE A CLAIM
You are not legally obligated to contest this forfeiture action or to file a claim. However, in the event it is your desire to contest forfeiture of the property identified above, Arizona law requires that any owner of or interest holder in the property may file a claim against the property at any time within sixty days after the notice of pending forfeiture or sixty days before a criminal trial, whichever is later, requesting a hearing to adjudicate the validity of the claimed interest in the property. An owner or interest holder may not be charged a filing fee or any other charge for filing the claim. Copies of the claim shall be mailed to the seizing agency and to the attorney for the state.
If submitted, the claim shall be signed by the claimant under penalty of perjury and shall set forth all of the following:
- The caption of the proceeding as set forth on the notice of pending forfeiture or complaint and the name of the claimant.
- The address at which the claimant will accept future mailings from the court or the attorney for the state.
- The nature and extent of the claimant’s interest in the property.
- All facts supporting the claimant’s claim in the property and its return to the claimant.
- The precise relief sought.
Your Claim must be filed in Navajo County Superior Court in the case number identified above and using the same case caption noted above. A copy of the claim must be sent to the seizing agency and the state to:

In the event you do not file a timely claim, the State will proceed with application for a judgment and order of forfeiture as provided under Arizona law.
- PROCEDURES AFTER FILING A CLAIM
If you do file a valid Claim, the State may file an
in rem
and/or
in personam
Complaint seeking forfeiture as set forth above. An Answer to any Complaint later filed by the State must answer the State’s cause of action, allegations and claims for relief and orders. An Answer must be filed within 30 days of service of the Complaint and it must be served on the State’s attorney. If a timely, proper Answer is not filed, the State may seek orders of the court to obtain an order of forfeiture of the property and all interests in the property and for a default judgment and a judgment against the named persons in the above case caption, and set forth in the Complaint and for the other claims for relief and orders set forth in the Complaint, including the
in personam
and/or
in rem
forfeiture of the property and all interests in the property set forth in Section IV, and set forth in the Complaint the State may file at a later date.
VII. NOTICE OF RELEASE OF PROPERTY BY POSTING BOND
Under the terms of A.R.S. § 13-4306 (G) and (H), an owner of property may be eligible for and obtain the release of seized property pending resolution of the case by posting a surety bond or cash in an amount equal to the full fair market value of the property, as determined by the attorney for the State. The State may refuse to release the property under this statute in some circumstances. If you post a bond or cash, the bond or cash will become subject to forfeiture in lieu of the original property. If you wish to post a bond or cash you must contact the attorney for the State. If you post a bond or cash and decide to defend an in personam forfeiture of the property, you must meet all the Claim and Answer and other requirements and obligations set forth above with respect to the bond or cash as if it were the original subject matter property.
If it is your desire to contest this forfeiture action, the time limit for filing a timely, proper, verified Claim in response to the State’s Notice of Pending Forfeiture or for filing any Answer to a State’s Complaint is not extended, enlarged, tolled, stayed, interrupted, or otherwise modified or changed by any time related to seeking and/or posting a bond or cash.
- ADDITIONAL NOTICE
the Clerk of Court cannot require the payment of a fee for the filing of a forfeiture Claim or Answer. No separate cost bond is required to make or file a Claim or Answer.
You are hereby on notice that the property, including all interests in the property, set forth in Section IV has been seized for forfeiture and is subject to this pending judicial civil forfeiture action. Participation in, exercise of, acceptance of, or acquiescence to any act or instrument that is contrary to or that could impede the purpose, intent and operation of this provision is in violation of the law and is subject to remedies and consequences provided by law.
Pursuant to A.R.S. § 13-4310(J), no person claiming to be an owner or interest holder in property seized for forfeiture may commence or maintain any action against the State concerning the validity of the alleged interest other than as provided in A.R.S. § 13-4301 et seq.
The Attorney for the State cannot assist you in preparing a Claim or Answer or any other documents and cannot provide you with legal advice or assistance. You may and should consult an attorney of your choice.
If you have not previously received a Notice of Seizure for Forfeiture or a Notice of Pending Forfeiture, this is such notice pursuant to A.R.S. §§ 13-2314, 13-3413, and 13-4301 et seq., including 13-4304, 13-4307, 13-4310, 13-4311, 13-4312 and 13-4313.
DATED and RESPECTFULLY SUBMITTED this 15th day of July, 2025.
